Purchase Agreement
Purchaser, by placing an order, makes an offer to purchase pursuant to these terms and conditions, which offer, if accepted by OxyHealth™ MiddleEast, its licensors, resellers, agents and its suppliers, is accepted within Spain, and purchaser consents to the jurisdiction of the courts of Spain for the limited purpose of dispute arising between the parties resulting from this transaction and agrees that the laws of the Kingdom of Spain shall apply. By opening or using a product purchased from us, the purchaser agrees to be bound by the terms and conditions of sale as set forth below.

By making payment the Purchaser hereby agrees, confirms and acknowledges the following: The information provided on this site is for educational purposes only and is not intended to support the safety or effectiveness of OxyHealth devices, or diagnose, treat, cure, or prevent any disease or condition. Any independent testimonies, reviews or views are applicable only to the individual providing them and individual results may vary. OxyHealth™ equipment is sold in the United Kingdom, MiddleEastan Union and other countries (“Markets”) as may apply by OxyHealth™ MiddleEast as commercial non-medical equipment for general wellness purposes only. For export, goods may be sold sold on a tax-free basis. When an order is shipped internationally, it may be subject to certain import procedures, clearances, taxes, customs, duties, certifications and/or fees imposed by the destination country. Although OxyHealth™ MiddleEast may assist where possible, OxyHealth™ MiddleEast does not undertake import nor assumes any responsibility for the import, process, fees, airport to door or return shipping fees (if any) which is the sole responsibility of the Purchaser at the destination Country. Warranty (parts & labor) on chambers for factory defects as of the invoice date – applies to NORMAL usage only. Warranty does not cover damage caused by misuse, Purchaser’s transport or shipment of unit or accessories. OxyHealth™ equipment is intended for general wellness purposes only in the Markets; hence no returns will be accepted unless return is warranty related. Restocking fees will be determined on case per case basis and will apply. Purchaser must familiarise themselves and read the Operating & Reference Manual in detail for set up & operation. OxyHealth™ MiddleEast, OxyHealth™ , OxyHealth™ LLC, OxyHealth™ Corporation and its distributors, its resellers, its agents, its affiliates, its licensors, its suppliers, its employees and its consultants (together hereby “OxyTeam”), to the fullest extent permitted by law, make no warranty whatsoever, either expressed or implied, of merchantability or fitness for any particular purpose, and none shall be implied by law. Final determination of suitability of any item sold for the use contemplated by purchaser is the sole responsibility of the purchaser, and seller shall have no responsibility in connection with such determination. OxyHealth™ MiddleEast and/or OxyTeam will not be responsible for any consequential or incidental damages resulting from the sale, non-delivery, use or improper function of any device or equipment purchased from us. The responsibility, if any is imposed, of OxyHealth™ MiddleEast in regard to any item purchased shall be limited only to the monetary value of the merchandise purchased.
Indemnity
Products are not intended to diagnose, treat, cure or prevent any disease.

You agree to defend, indemnify, and hold OxyHealth™ MiddleEast, OxyHealth™ , OxyHealth™ LLC, its officers, directors, employees, agents, licensors, resellers, affiliates, and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, any dispute between buyer and OxyHealth™ MiddleEast and/or OxyHealth™ LLC. You agree to defend, indemnify, and hold OxyHealth™ MiddleEast, OxyHealth™ LLC its officers, directors, employees, agents, licensors, resellers, affiliates, and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from your violation of these Terms and Conditions. In no event shall OxyHealth™ MiddleEast™ , OxyHealth™ LLC, its licensors, its suppliers, or any third parties mentioned on the OxyHealth™ MiddleEast Site be liable for any damages (including, without limitation, incidental and consequential damages, personal injury/wrongful death, lost profits, or damages resulting from lost data or business interruption) resulting from the use of or inability to use the OxyHealth™ MiddleEast Site or the Content, whether based on warranty, contract, tort, or any other legal theory, and whether or not OxyHealth™ MiddleEast, its licensors, its suppliers, or any third parties mentioned on the OxyHealth™ MiddleEast Site are advised of the possibility of such damages.
